The Responsibilities of Our Process Servers

ELECTRONIC ACKNOWLEDGMENT OF SERVICE AGREEMENT

This Agreement is entered into between the Client and Ohio Security & Investigations, LLC (hereafter referred to as the Service Provider) and establishes the legally binding terms under which civil process services will be rendered. By electronically submitting this Agreement, the Client affirms full understanding, consent, and acceptance of the terms outlined below.
Section 1: Acceptance of Terms  
The Client acknowledges that they have read, understood, and agreed to the terms of this Agreement. Submission constitutes a legally enforceable contract under the laws of the State of Ohio.
Section 2: Scope of Services 
The Service Provider performs civil and legal process services in strict compliance with applicable laws and procedures. No legal advice, consultation, or representation is provided or implied.
Section 3: Client Responsibilities  
The Client is responsible for providing all necessary information, including accurate names, valid addresses, supporting documentation, and any relevant instructions for service. The Service Provider shall not be held liable for service delays or failures resulting from incomplete, inaccurate, or untimely submissions.
Section 4: Service Levels and Timing  
Routine Service is provided at a rate of $65.00, with the first attempt occurring within five to seven business days. Expedited Service is available at a rate of $85.00, with the first attempt occurring within one to three business days. Same-Day Service is offered at $99.00, provided all materials are received before 12:00 PM on the date of service. Each service level includes up to three attempts per address, per individual, unless otherwise stated. A basic notarized affidavit of service, non-service, or posting is included at no additional cost.
Section 5: Confidentiality  
All documents and information submitted by the Client will be handled with strict confidentiality and used solely for the execution of requested services. The Service Provider adheres to all relevant privacy and data protection laws.
Section 6: Additional Charges  
Additional fees may apply as follows: designated time service is billed at $65.00 per hour. Multiple addresses or additional individuals will incur a separate fee of $65.00 each. Mileage beyond five miles is billed at $0.70 per mile. Detailed affidavits, if requested, carry a $65.00 fee. Late payments exceeding thirty days are subject to a $50.00 monthly late charge. After-hours service incurs an additional $50.00 fee, and service on recognized holidays incurs an additional $100.00 fee. Skip tracing is billed at $75.00 per individual. Surveillance services are billed at $65.00 per hour with a three-hour minimum. Errors in notarization caused by the Client will result in a $5.00 notarization fee and a $5.00 convenience fee per occurrence. Court filing or document retrieval is charged at $50.00 per event. Body camera footage transferred to USB media, or evidentiary media including photographs, GPS, or video files, will be released only under lawful requirement or Client request for a $50.00 processing fee. Elusive and hard-to-find subjects are billed at an investigative rate of $65.00 per hour plus $0.70 per mile.
Section 7: Cancellation and Refund Policy  
If canceled before service preparation, a refund will be issued minus a $5.00 administrative fee. Once preparation begins or a service attempt is made, no refunds will be granted. The Service Provider retains payments to cover labor and processing expenses.
Section 8: Court Readiness Disclaimer 
The Client is solely responsible for ensuring the legal sufficiency and court-readiness of all submitted materials. The Service Provider shall not be held liable for any consequences arising from untimely, inaccurate, or noncompliant documentation.
Section 9: Safety and Property Restrictions  
Ohio Security & Investigations, LLC prioritizes the safety of its process servers and investigators while maintaining strict compliance with legal requirements. The following restrictions apply. If a subject exhibits vulgar, aggressive, or violent behavior toward a process server or investigator, no additional attempts will be made. The service will be documented as non-service, and the Client will be notified. No refunds will be issued for incomplete service due to safety concerns. If a "No Trespassing" sign is prominently displayed on the property, the Service Provider will not attempt service. This will be documented as an affidavit of non-service, and the Client will be notified accordingly, unless the process server has been appointed as a special standing process server under Ohio Revised Code (ORC) 311.22, granting them the same authority as a sheriff. If the Client is aware that the subject may be dangerous or violent and fails to disclose this information, the Client will be held financially liable for any injuries or damages sustained by the Service Provider’s process servers or investigators while attempting service. Not only will the injured employee file suit against the Client, but Ohio Security & Investigations, LLC will also pursue legal action against the Client for negligence and damages.
These policies ensure compliance with Ohio law, maintain safety, and uphold professional standards in all service attempts.
Section 10: Payment Authorization  
By submitting this Agreement, the Client authorizes the Service Provider to collect payment for all agreed-upon services and charges. Payment is due upon receipt of invoice unless otherwise documented in writing.
Section 11: Governing Law and Jurisdiction
This Agreement shall be governed in accordance with the laws of the State of Ohio. Any disputes or legal actions related to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Mahoning County, Ohio, where the Service Provider operates.
Section 12: Electronic Signature and Consent  
By submitting this form electronically, the Client agrees to be legally bound by the terms outlined herein, in accordance with the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Ohio Uniform Electronic Transactions Act (UETA). Submission constitutes the legal equivalent of a handwritten signature.
